Fenton, MO (KSDK) -- A man is in police custody after being shot in the leg during an attempted burglary, the Jefferson County Sheriff's Office said Wednesday.
24-year-old Richard Bates is charged with first degree burglary, theft of a firearm and unlawful use of a firearm.
Police say that at approximately 2:00 a.m. on Tuesday, officers responded to a home on Creek Dr in Fenton for a reported burglary. The victim, a 59-year-old man, says he awoke to find a male subject standing in a bedroom of the home, armed with a handgun.
The victim says he responded by pulling a handgun and firing two shots at the suspect, who fled from the scene.
Police say a short time later, Bates arrived at St. Clare Hospital in Fenton with a gunshot wound to the leg. He was treated and released.
Deputies took Bates into custody and transported him to Jefferson County jail. His bond is set at $75,000.
Officials say no charges are being filed against the victim in relation to the shooting.
