Jefferson City, Mo (KSDK) -- A St. Louis man who served more than 30 years in prison for a rape and murder he did not commit could be freed Wednesday.

Cole County Judge Daniel Green vacated George Allen Jr.'s 1983 conviction earlier this month citing DNA and other evidence that called the conviction into question.

Mary Bell's body was found inside her Lafayette Park home on February 4, 1982.  She'd been raped, stabbed and her throat was slit.

Missouri Attorney General Chris Koster appealed the court's ruling overturning the conviction.   The appeals court will have to make a decision before Allen can be freed.

Judge Green is expected to sign an order Wednesday morning releasing Mr. Allen on his own recognizance pending the resolution of the appeal.
