Attorney General Chris Koster reaches agreement in raw sewage lawsuit

JEFFERSON CITY, Mo. (KSDK) - An agreement has been reached in a lawsuit against Great Southern Bank and Clear Cove Landing Homeowners Association II.

Attorney General Chris Koster filed the agreement which orders both the bank and the homeowners association to stop raw sewage from leaking into Table Rock Lake.

Great Southern Bank has owned the subdivision's wastewater treatment facility since 2007, along with approximately one-third of the lots in the subdivision.

The Department of Natural Resources inspectors found the following violations:
- Causing or permitting discharge of contaminated water - raw sewage - through bypassing the treatment system in a location where reasonably certain to cause pollution to water
- Operating, using, or maintain the treatment facility without a state permit
- Failing to pay permit operating fees for years 2007-2011, totaling $7,904 in unpaid fees and late penalties

The bank and homeowners association have agreed to fix the water treatment facility and comply with the Clean Water Law.

A civil penalty up to $10,000 per day for each violation of the Clean Water Law is also asked to be assessed in the agreement.
