ST. CHARLES COUNTY, Mo. (KSDK) - Two St. Charles County men will not have criminal charges filed against them after being arrested last month for failing to obey the directives of Missouri State Highway Patrol officers.

Marc S. Messmer, 41, of St. Charles, and Jimmy D. "Duane" Weed, 57, of Bridgeton, were with a group of anti-Obama protesters on the Fairgrounds Road overpass above Interstate 70 when they were asked to leave for allegedly distracting motorists below.

Highway Patrol reported that the interstate was unusually congested at the time and that at least five separate accidents occurred in the vicinity of the protests.

"The Highway Patrol has a job to do, and that includes ensuring that our roadways remain safe. However, based upon the facts and circumstances, we do not believe that criminal charges are appropriate, nor do we believe that we can prove that a crime occurred," St. Charles County Prosecuting Attorney Tim Lohmar said.

NewsChannel 5 intern David Schuman contributed to this report.
