Tuesday, the man accused in the killing appeared in St. Clair County court.

Gary Warwick is charged with first-degree murder in the killing of a 1-year-old boy. Joseph Henry Abernathy III was killed on December 30,1972.

Soon after, Warwick was charged with the crime. But according to published reports, the case was dismissed the next year without explanation.

The case went cold until the baby's family started an online petition and YouTube campaign called 'Justice for Joey.'

It convinced the St. Clair County Sheriff's Office to reopen the case.

A judge has set a tentative trial date for June 19.
