Man hurt trying to stop theater attack

ST. CHARLES, Mo. - A St. Charles man says he was injured trying to stop a mentally ill man from assaulting a female caseworker. Now, six weeks later, he says he's out thousands of dollars in medical bills and isn't getting the help he's owed.

Jim Licare was at the St. Andrews Cinema with his son when he says a man in front of them started getting upset.

"His band aid came off and he was bleeding and his caseworker wanted to put a new band aid on him. And when he refused he started getting extremely loud and aggressive," said Licare.

The man was part of a group from Emmaus Homes, a non-profit organization that serves adults with developmental disabilities. Licare says the caseworker and her upset client left the theater and went into the hall and that's when things turned violent.

"He was screaming," said Licare. "I could hear someone getting banged against the wall."

Licare also stepped into the hall.

"I said, 'What's going on? Do you need help?' She said, 'Yes, I need help.'"

Licare tried to restrain the man, but the man continued to struggle.

"That's when we went down and both our bodyweights landed on my elbow on the concrete floor," said Licare.

Doctors told Licare he may have nerve damage. And Licare says Emmaus Homes told him he'd be taken care of.

"We have encouraged our insurance company to provide the information necessary to settle this claim and move forward," said Emmaus Homes' Executive Director Lisa Drier.

Drier says there haven't been any hang ups with the claim. But Licare says otherwise.

"I was basically told it was my fault for stepping in," said Licare. "If I would have minded my own business I wouldn't be hurt and they won't cover anything."

Licare says he's now missed six weeks of work and just wants fair treatment.

"It's not his fault. He's mentally sick, I understand that. But they are responsible for his actions," said Licare.

NewsChannel 5 reached out to Philadelphia Insurance Company to ask about Licare's claim, but didn't get a response.

Lisa Drier she doesn't know how long it will take to get the claim taken care of.
