Mom leaves 3 week old baby in car, no criminal charges

Chesterfield, MO (KSDK) - A mom is accused of doing the unthinkable while shopping in Chesterfield.

Investigators say she left her three-week old baby alone in the car for at least 45 minutes!

We wanted to know why Chesterfield police didn't charge this mother with a crime.

They told us that had the infant been hurt, she would've been charged with more, but since the baby was not hurt, she was cited with child endangerment.

Her punishment will most likely be a fine.

"Her statement to police was if she would've gotten the baby out of the car then he would've woken up and started crying so, she didn't want to wake the baby so she felt it would be better in the car running," Chesterfield Police Detective Jeff Ovca said.

He says it happened Sunday afternoon when another shopper at the Chesterfield Babies "R" Us store says they walked passed a running car as they were going in the store.

When they came back out, they noticed the car was still running and then saw an infant was inside, so they called police.

Detective Ovca says the car was not hot inside, but was running and the doors were unlocked.

Other shoppers say the mom should be in more trouble.

"I think she should've went to jail, as a parent you take the responsibility why didn't she just get her child and take it into the store, it's just that simple," mother Chastity Gaines said.

"Even if you are busy or not busy that doesn't matter at all, it's your baby and you have to take care of it whether it's a three month old a three week old or a ten years," mother Deepa Vishy said.

Police say the mom does not have a criminal past.

The Department of Family Services is investigating.
