Nassau County, NY (WCBS/CNN) - New York man accused of faking his own death is reportedly in a Long Island hospital.

Raymond Roth's lawyer says he was involuntarily committed for psychiatric evaluation and is expected to surrender to face charges when doctors feel he is no longer a danger to himself.

Roth is accused of faking his own death by drowning to collect on a life insurance policy.

The 47-year-old was reported missing by his son July 28th at Jones Beach.

The son, 22-year-old Jonathan Roth, was arrested and charged after he admitted his 911 call was a lie and that he knew that his father had left the beach to head to Florida.

Raymond Roth's wife believed he had drowned until she found emails between the father and son exposing the alleged plan.

Both she and Roth's attorney are painting very different pictures of her husband.

"He's a horrible person, he's is an alcoholic. He's just an abuser in every which way," said his wife, Evana Roth.

"He is not an ogre. He does have psychiatric issues," said Raymond Roth's attorney, Brian Davis.

Davis says Roth was fired from his job and that set off a string of "irrational moves."

The younger Roth says he's an innocent victim of his father's plot and has pleaded not guilty.

But, police say he had a deal to get more than $50,000 of the insurance money.

Raymond Roth has not officially been arrested or charged.

Prosecutors say charges are likely to be filed in the coming days.
