Kmart sued over HVAC systems at former St. Louis Marketplace store

Kmart closed that store in January 2017, along with its Alton and Granite City locations.

The owner of St. Louis Marketplace shopping plaza is suing Kmart Corp. for allegedly failing to pay for 12 HVAC units totaling over $166,000.

Property owner 14 Oaks Associates LLC alleges Kmart vacated its store at 6650 Manchester Ave. before repairing 12 HVAC units on the building’s roof, as well as replacing missing sprinkler heads, according to a lawsuit filed in the Eastern Missouri District federal court. 14 Oaks alleges lease terms dictate that Kmart is responsible for ensuring the property is left in “good order and condition” and that Kmart has yet to make or pay for the repairs. The department store owes 14 Oaks $166,027.04, according to the suit.

Kmart closed that store in January 2017, along with its Alton and Granite City locations. On Jan. 28 of this year, it will also shutter its south St. Louis County location, leaving locations in Florissant and Crystal City as the only remaining area Kmarts.
